Terms of Service

This document governs access to and use of the CoMuse AI-powered interactive storytelling platform ("CoMuse", "we", "us"). CoMuse is incorporated in England and Wales, and these policies reflect UK requirements. By creating an account or using any CoMuse feature—including AI story generation, Genius Map analysis, or child profiles—you agree to the Terms of Service below. If you disagree with any provision, do not access CoMuse.

1. Eligibility & Accounts

  • • You must be at least 13 years old (or the minimum age required by your jurisdiction) and able to consent to these Terms.
  • • You are responsible for maintaining accurate registration data, safeguarding passwords, and promptly notifying us of unauthorized activity.
  • • CoMuse may suspend or terminate accounts for violations of these Terms, non-payment, or suspected abuse.

2. Acceptable Use

  • • Use CoMuse only for lawful creative work. Do not upload or generate content that is illegal, defamatory, infringing, or harmful.
  • • Automated scraping, reverse engineering, security probing, or attempts to bypass usage limits are prohibited.
  • • You must respect our API rate limits, subscription tier caps, and any queueing applied to AI services.

3. AI Output & User Content

  • AI-Generated Content: AI outputs (stories, behavioral assessments, Genius Map reports) are generated probabilistically using Google Gemini and may be inaccurate, incomplete, or inappropriate. They are not professional diagnoses or guarantees of your child's abilities.
  • Your Responsibility: You are responsible for supervising your child's use of AI features and reviewing all AI-generated content. Do not rely solely on AI assessments for educational or developmental decisions.
  • Content Ownership: You retain ownership of content you create. We use anonymized interaction data to improve story quality and AI models.
  • Content Filtering: We employ content filters but cannot guarantee 100% safety.

4. Third-Party Services

  • • CoMuse integrates with Clerk (authentication), Supabase (database, storage), Google Gemini (AI generation), and Stripe (payments). Their respective terms apply when those services are used.
  • • Authentication occurs via standard methods (e.g., email, third-party providers). Additional security steps (2FA, passkeys) may be introduced to protect the platform.

5. Subscription Plans & Payments

  • Available Tiers: Subscription plans with features as described in-app.
  • Auto-Renewal: Paid plans auto-renew each billing cycle unless canceled via your Stripe billing portal (accessible from Settings).
  • No Refunds: All subscription fees are non-refundable. By subscribing, you expressly agree to immediate access to Premium features and waive your 14-day cancellation right under UK Consumer Rights Act 2015. You may cancel anytime, but no refunds for unused time or partial periods.
  • Exceptions: Refunds only for unauthorized charges (report within 48 hours) or duplicate billing errors.
  • Price Changes: We may change pricing with 30 days notice. Continued use constitutes acceptance.

6. Copyright & DMCA

  • • Report suspected infringement to support@comuse.co.uk with: your contact info, description of the work, location of the allegedly infringing material, and a statement made under penalty of perjury.
  • • We may remove content and terminate repeat infringers as required by law.

7. Disclaimers & Liability

  • • CoMuse is provided "as is." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement.
  • • To the fullest extent permitted by law, CoMuse is not liable for indirect, incidental, punitive, or consequential damages, or for loss of profits, data, or goodwill. Our aggregate liability is limited to the fees you paid to us in the 12 months preceding the claim.
  • • Certain jurisdictions do not allow limitations on implied warranties or liability; in those cases, the relevant limitations apply to the maximum extent permitted.

8. Termination

  • • You may delete your account at any time through Account Settings.
  • • We may suspend or terminate accounts that violate these Terms, exceed fair use, or create security risk. Upon termination we may retain minimal data necessary to comply with legal obligations or resolve disputes.

9. Governing Law & Disputes

  • • These Terms are governed by the laws of England and Wales, excluding their conflict-of-law rules.
  • • Disputes will be resolved exclusively in the courts of England and Wales (London jurisdiction), except that either party may seek urgent injunctive relief wherever necessary to protect intellectual property or confidential information.
  • • Nothing in these Terms limits any non-waivable rights you may have under UK consumer protection law.

10. Updates

We may update these Terms to reflect new laws, features, or business requirements. Material changes will be posted in-app or via email. Continued use after changes become effective constitutes acceptance.
